Motion to Suppress HGN and PBT using NHTSA DWI Detection manual and systematic cross-examination. Although I lost on the issue of PC for the arrest, this was a great motion and provides an example on how to cross-examine a police officer on field sobriety tests. HGN was suppressed but the PBT was admitted and that PBT provided reasonable grounds for the arrest in combination with the driving behaviors. Based upon our claim of (a potential) appeal, the prosecution and I worked out a great deal to a non-DUI resolution. And despite the title "crushing the cop," this officer did a great job on the stand, and I go up against this officer all the time & he's actually a good cop.
