Ocean City Tourist Arrested for DWI in Rental Car While Leaving Casino

LONGPORT, NJ - On October 1st, 2020 at 11:22PM, an officer with the Longport Police Department observed a vehicle traveling at a high rate of speed on Ventnor Ave. After the officer got behind the car, he activated his emergency lights and pulled the vehicle over just before crossing the JFK Memorial Bridge. When asked why the suspect was speeding, he claimed to have thought that the speed limit was higher. The suspect further claimed that he was not familiar with the rental car. While verifying the suspect's identification, the officer discovered that his temporary license had an interlock ignition device restrction.

The officer questioned the suspect who claimed that his lawyer told him he did not have to have an ignition interlock device due to the vacation being planned prior to the restriction being put in place. The officer then asked the suspect to recite the alphabet starting with the letter "E" and ending with the letter "T." The suspect recited the remaining portion of the alphabet beginning with the letter "E." The officer asked the suspect to step out of the vehicle to which the suspect complied. While being questioned, the suspect claimed that he had two beers in the night and claimed that he would perform any test the officers wanted him to take.

During the horizontal gaze nystagmus test, distinct and sustained nystagmus at maximum deviation and a lack of smooth pursuit was present in both eyes. For the walk-and-turn test, the suspect had to be told to return to the starting position and did not touch heel-to-toe on any of the steps. After the officer instructed the suspect on how to perform the one leg stand, the suspect did not raised his foot well below six inches and did not count in one-thousands after the number 10. Following the completion of the tests, the officers discussed the suspect's performance and decided to arrest him for driving while intoxicated, or DWI. He was then transported to the Longport Police Department for further processing.
