Making mistakes when navigating the compensation system is more common than you think. To help you avoid costly errors, I’m going to go reveal three of the most common mistakes made with personal injury claims and explain some examples, which will hopefully help you avoid them.

Having worked in personal injury law for over 14 years, I’ve seen countless mistakes made by people, who should primarily be focussing on their recovery, lodging their own claims and it unfortunately ends up costing them hundreds of thousands of dollars in compensation they’re entitled to. Personally, this is devastating to see because it not only hurts them financially but can also jeopardise their ability to receive necessary treatment. So, in order to help you avoid this I’m going to reveal and carefully explain three of the most common mistakes made in personal injury claims.

1: Many people fail to get a full head-to-toe assessment from their doctor

This mistake can see legitimate secondary injuries sustained in an accident go undetected and result in missing out on compensation you’re entitled to. This often occurs because you aren't speaking up or because the doctor's attention is focused on the main injuries at the time. It's even possible that you can develop further injuries many months after the original incident.
For example, we settled a case for a client who had a significant knee injury that occurred in the workplace. He developed a limp over many months, so we sent him for a full head-to-toe assessment which proved considerable damage to his hip and back. As a result he was able to not only claim compensation for those body parts but also receive the treatment he needed.

2: Don’t be tempted to accept a quick settlement offer from an insurer without speaking to a personal injury lawyer.

Remember these claims can be difficult and complex, and it's the insurer's aim to try and minimise the amount of compensation that they pay out. Sometimes their first and second offers can be quite low just to see whether or not you're willing to accept it - so having expert advice can provide you the guidance you need to make the right decision in this situation.

3: Assuming all personal injury lawyers are the same.

For me, this is the most costly mistake or assumption a person can make. When it comes to personal injury claims, there are a lot of specialists out there but there aren’t as many specialists willing to deliver the client care you deserve. And in order to help you to claim all that you’re entitled to, they need to be willing to get to know you and how the injury has specifically impacted your life and the life of your loved ones. So when choosing a lawyer, make sure you find a specialist who is asking the right questions and can deliver the client care you deserve.
