A person has three years to bring a copyright infringement lawsuit. The lawsuit must be filed within three years of the following:
1. The date you discover your work has been infringed upon; or
2. The date the work was released to the public.
Most courts lean towards deciding if the lawsuit has been brought within three years based on option two. Determining when someone discovered the infringement can be so fickle that most like to stick with a universal date which is the date of publication. Making it the copyright holders responsibility to police their copyrights.
