Want to use a dead trademark? Be careful -- it might not really be dead!

Just because a registration is expired doesn't mean a trademark is not "in use" by the former registrant. It might just mean that the trademark owner forgot to renew the registration, but they are still using the mark.

So long as the mark is still being used, the trademark owner still has rights to the trademark, so don't assume that use has stopped just because the trademark registration has expired.
