In order to stop someone from stealing your brand or intellectual property, you can send them a cease-and-desist letter.
A cease and desist letter serves as a warning shot before the actual lawsuit. If the infringer fails to stop using your intellectual property, the next step is to actually file a federal lawsuit.
Registering your brand name gives you the ability to be “unique” in the marketplace. This means that you have the exclusive right to use your brand and intellectual property.
This also means that you as the brand holder must enforce and police the protection of your brand.
